General Conditions

By purchasing an Entrance Ticket or attending the event, you agree to the House Rules and General Terms and Conditions of Stichting Rebirth Events, REBiRTH Events B.V., REBiRTH Festival B.V. and REBELLiON Outdoor B.V.. These are filed below.

Article 1. Definitions

“Organization” means one or more of the following organizations affiliated with REBiRTH Festival B.V., which always organize their own events independently, namely Stichting Rebirth Events, REBiRTH Events B.V., REBiRTH Festival B.V. and REBELLiON Outdoor B.V. statutorily established in Haaren registered under Chamber of Commerce number: 59479191 / 82282846 / 88085058 / 94702276, as well as the (legal) persons responsible for organizing an Event on its behalf.

“Event”: Any activity(s) organized by the Organization including, events, festivals, music festivals, hospitality and festival camping(s), in the broadest sense.

“Visitor” means any natural person not acting in the exercise of a profession or business who, whether or not on behalf of a company, directly or indirectly enters into an agreement with the Organization with respect to attending an Event organized by the Organization and/or purchasing and acquiring one or more Admission Tickets for an Event organized by the Organization as well as any person who moves in or around the Venue and/or has entered into an agreement with the Organization, whether or not directly or indirectly, pursuant to which admission to the Event may be provided.

“Entrance Ticket” or “Entrance Tickets” means a (digital) document or a (bar) code issued by or on behalf of the Organization, validly obtained by Visitor, and which enables Visitor to gain admission to the specifically designated Event.

“Tokens” means tokens issued by or on behalf of the Organization, which Attendees may purchase for an amount determined by the Organization, and which may be used as a means of payment during the Event at places designated by the Organization for that purpose.

“Grounds”: All buildings, spaces (covered or uncovered), fields, which are part of the area where the Event takes place, including also the approach routes and parking lots, and including, where applicable, the Campsite and/or Accommodation.

“Accommodation” means a part of the Venue specifically designated by the Organization for Visitor to stay during the Event, whether or not equipped with a specific facility for Visitor (for example: festitent, delta deluxe, snoozy, festipi, flexotel or friendscamp). The Accommodation also includes the facilities.

“Campground” means a part of the Terrain specifically designated for that purpose by the Organization where Visitor, who has purchased a specific Entrance Ticket for that purpose, may stay and stay overnight during the Event, including, where applicable, an Accommodation.

Article 2. Applicability

2.A. These general terms and conditions shall apply to any part of the agreement relating to services or products of any kind to be provided by the Organization, unless otherwise expressly agreed in writing.

2.B. The Terms and Conditions can be viewed and saved on the website of the Organization and the Event and are visibly available for inspection at Organization’s office and at the entrance to the Event. House Rules may apply to an Event. The Visitor hereby expressly declares that he/she agrees to the House Rules in question and also declares that he/she will behave in accordance with those House Rules.

2.C. During the Event, these general terms and conditions shall apply to all (further) agreements which the Visitor concludes with the Organization (including the purchase of Tokens and the items and goods purchasable with them).

2.D. Typographical errors in offers of the Organization shall indemnify it from any obligations of performance and/or compensation that may arise therefrom, even after the conclusion of the agreement.

2.E. During the Event, these general terms and conditions shall apply to agreements concluded with or through or by intermediation of official (advance) sales addresses designated by the Organization for that purpose, including, where applicable, so-called secondary ticketing platforms.

2.F. If a Visitor orders an Entrance Ticket or Entrance Tickets for a third party, the Visitor declares that he or she is authorized to accept these General Terms and Conditions and will inform the third party of the applicability of these General Terms and Conditions.

2.G The applicability of any general terms and conditions of Visitor (by whatever name) is hereby expressly rejected by the Organization.

2.H The invalidity of any provision of these general conditions shall not affect the validity of the remaining provisions of these general conditions.

2 I A stay and/or visit to a campsite or accommodation designated by or on behalf of the Organization may, in addition to these general conditions and the House Rules, be subject to any (general) conditions and/or house rules of the campsite and/or accommodation concerned.

Article 3. Liability

3.A. The Visitor is a consumer: the liability of the Organization is limited to compensation for direct damage, whereby the amount to be paid to the Visitor shall never exceed the amount paid by the insurer of the Organization in the case in question. For indirect damages, including consequential damages, lost profits, lost savings and damage due to business interruption is hereby expressly excluded the liability of Organization.

3.B. The Visitor is a (legal) person or company otherwise acting in the exercise of a business or profession: the Organisation is only liable for damage suffered by the Visitor if and insofar as that damage is the direct result of intent or conscious recklessness on the part of managers of Stichting Rebirth Events, REBiRTH Events B.V, REBELLiON Outdoor B.V. and/or REBiRTH Festival B.V. The liability in this case is limited to compensation for direct damage up to the amount paid out by the organization’s insurer in the case in question. For indirect damages, including consequential damages, lost profits, lost savings and damage due to business interruption, the Organization’s liability is hereby expressly excluded.

3.C. The Organization is not responsible for the manner in which artists / acts interpret and perform (their performances during) the Event.

3.D. Adjustments in the program of the Event that occur after purchase of the Entrance Ticket will not entitle Visitor to cancel the purchase. There will be no refund of the purchase price.

3.E. Entry to the Premises during and or prior to the Event is entirely at the Visitor’s own risk. Lockers for the storage of valuables are available on the Terrain, unless otherwise indicated. Use of a locker by Visitor is entirely at Visitor’s own risk. The Organization is not responsible and accepts no liability for damage to or loss or theft of Visitor’s belongings.

3.F. The Visitor declares to be familiar with the fact that amplified music will be played during the Event. The Visitor is responsible for taking hearing protection measures as required. The Organization advises the Visitor to give his/her hearing due rest during the Event and to wear (adequate) hearing protection.

Article 4. Force Majeure

4.A. In case of force majeure, the Organization has the right to change the Event, cancel it in whole or in part and/or move it to another date and/or place. In addition to the meaning given to it by law, ‘force majeure’ includes all unforeseen circumstances beyond the control or control of the Organization such as; bad weather, fire, strike, cancellation by artist(s), a pandemic, natural disruption, (threat of) war and terror etc.

4.B. If, as a result of or in connection with force majeure, the Event is cancelled in its entirety before the Event has begun, the Organization will reimburse Visitor for the purchase amount (excluding booking fees) of the Entrance Ticket. The Visitor may not claim against the Organization any compensation or damages other than the refund of the purchase amount. Refunds will be made only after the Visitor has submitted to the Organization a valid and undamaged original Entrance Ticket. In other cases, there is no entitlement to a refund.

Article 5. Dissolution

5.A. The Organization has, in addition to the grounds mentioned in the law, the right to terminate the agreement with Visitor in whole or in part in case of (imminent) violation of these general conditions and/or applicable House Rules, force majeure and/or other circumstances that make it unreasonable for the Organization to maintain the agreement with the Visitor. This means that the order of Admission Tickets may be cancelled by the Organization in the interim. Entry Tickets that have been purchased are no longer valid from that moment on. In the event of interim cancellation of an order by the Organization as referred to herein, the full original purchase price (excluding booking fees) will be refunded to the Visitor. The Visitor cannot claim any compensation or damages. In the event of cancellation of an order after an Entrance Ticket has been issued to the Visitor, a refund will only be made after the Visitor has surrendered a legally obtained original, valid and undamaged Entrance Ticket.

Article 6. Entry to the Event

6.A. The Minimum Age for admission to the Event is 18 years, unless otherwise specified by the Organization. Only a validly obtained original, valid and undamaged Entry Ticket gives access to the Event.

6.B. In order to gain access to the Event and the Terrain, the Visitor must be in possession of a valid identification document (identity card, passport or dutch driver’s license), this must be shown at the first request of or on behalf of the Organization. Access is possible from opening time to closing time. Exact times of opening and closing are listed on the website of the Event. Closing time does not necessarily also mean the end time of the Event. For security reasons, it is not possible to temporarily leave the Terrain after entry, unless expressly agreed to by the Organization. The Organization may also impose further conditions on the latest time of entry to the Terrain and Event.

6.C. The Organization may decide to provide Visitors with a wristband, making it easily visible to which part of the Terrain the Visitor in question has access. The Visitor declares that he/she will cooperate with this. The Visitor must carry the wristband at all times during the Event and on the site in the manner indicated. In case of loss of the wristband or breaking the seal of the wristband, the Visitor can be removed from the Site and denied further access by or on behalf of the Organisation.

6.D. Visitors will be searched on entering the Premises; items brought along by the Visitor may be searched on the Premises and also during the Event. The Visitor expressly agrees to this and will cooperate at first request. The Organization will determine how this search will reasonably take place. This may be by security guards, detection gates and/or by other means. If the Visitor does not cooperate, the Visitor will be denied access to the Venue and Event.

6.E. For reasons of security, the Organization may decide to close parts of the Terrain during certain times or keep it open only for certain Visitors. Visitor is then prohibited from entering those parts of the Terrain. Visitor shall strictly comply with any further instructions given by or on behalf of the Organization.

6.F. On the Terrain, the Visitor shall strictly follow the instructions of the staff of the Organization and third parties engaged by it, such as staff of the police, fire department, GGD, first aid, security guards, (parking) stewards, traffic controllers and or other authorized bodies.

6.G. The Visitor is only permitted to carry the items listed below for personal use at the time of entering the Premises, unless otherwise stated in the House Rules of the Event or unless more items are permitted on certain parts of the Premises by or on behalf of the Organization:

1: Medications (hereinafter referred to as “Medications”);
2: Sunscreen in tube of maximum (100 ml) and lip balm;
3: Cell phone and power bank;
4: Backpack;
5: Hearing protection (earplugs);
6: Cigarettes and lighter;
7: Keys, wallet;
8: Clothing, shoes, poncho, (sunglasses), lenses, cap;
9. E-Smoker (no refills).

The list of items, substances and/or resources listed below is a listing of items that are not permitted. This is a representation of a non-exhaustive list to which the Organization has the right to add items that, in its judgment, are necessary to ensure safety on the Premises and Event.

1: Provocative clothing and flags or clothing of soccer clubs, motorcycle clubs or the like;
2: Professional photo, film and other recording equipment and selfie sticks;
3: Narcotics or drugs similar to them (including nitrous oxide);
4: Pets;
5: Liquids such as (aerosols containing) deodorant, lighter gas and perfume;
6: Glassware, sharp objects, umbrellas, (fire) weapons, laser pens, fireworks;
7: Food and drink (both alcoholic and non-alcoholic beverages).

A Visitor carrying unauthorized items, substances and/or drugs will be denied access to the entire Site and Event. If, after entering the site, the Visitor is found to be carrying unauthorized items, substances and/or drugs, the Organization will remove the Visitor from the site or have them removed, thereby forfeiting the right to any form of refund of tickets or the purchase of Tokens. Access to all Events will also be denied for a period to be determined by the Organization. By law, the Organization will take possession of prohibited items, substances and/or drugs and hand them over to the police. In case of violation of the Opium Act Visitor will be handed over to the police by or on behalf of the Organization.

The Organization will confiscate (or have confiscated) items, substances and/or resources found as referred to in this article. Valuable legal items can be collected by the Visitor after the Event. Illegal items will be handed over to the police. If illegal items, substances and/or means are found, the Organization will refuse the Visitor access to the Event.

6.H. In the case of “Medications” it is only permitted to bring them to the Event if the additional conditions below are met. If these are not met or the Organization has other grounds for doubting the displayed, then the Organization is authorized to confiscate (or have confiscated) the Medications. This means that if the “Medications” are confiscated, the Organization will not reimburse them and will deposit them in the appropriate bin and hand them over to the police.

If the Medications are in the original and sealed packaging and come with the original package insert, the Visitor must show why these medications are being used by means of a doctor’s statement. If in doubt, the medication will be evaluated by an on-site physician.

Article 7. Acting in violation of the House Rules and general conditions

7.A. If the Visitor violates or threatens to violate the Agreement (which includes the House Rules of the Event and these general terms and conditions), he or she will be removed from the Premises and denied further access to the Premises and the Event. Also, the denial of access will also apply to future Events of the Organization. The Visitor is liable for all damages and costs incurred by or on behalf of the Organization.

Article 8. Entrance ticket

8.A. At the moment that the Visitor has purchased one or more Admission Tickets for an Event in a legally valid manner – that is, by means of the (advance) sales addresses designated by the Organization – the agreement with the Organization is concluded. The Admission Tickets are purchased through the Organization or from an official advance sales address designated for that purpose by the Organization. The Entrance Ticket gives access only to those parts of the Site and/or Event as indicated by the Organization and/or on the Entrance Ticket. On returning the Admission Ticket, the Visitor grants himself access to the Event. An Entrance Ticket issued entitles a single natural person to admission to the Event.

8.B. Only the holder of the Entrance Ticket who has lawfully obtained it and is the first to present it at the Event will be admitted to the Event. The Organization is not obliged (but authorized) to verify whether the holder of the Admission Ticket is the legitimate owner and/or has obtained the Admission Ticket(s) in a valid manner.

8.C. The Entrance Ticket(s) for the Event in question will be issued once in a manner to be determined by the Organization (including by e-mail). The Visitor declares to have adequate means to physically present the Entrance Ticket at the entrance to the Event. The Visitor himself will ensure that he becomes and remains the holder of the Admission Ticket issued by the Organization or by an official advance sales address engaged by the Organization. From the moment the Admission Ticket is first issued to the Visitor, the risk of loss, theft, damage or misuse of the Admission Ticket passes to the Visitor.

8.D. The Organization has the option of having a procedure applicable, which the Visitor must go through after payment of the Entrance Ticket in order to have it declared valid or received. This procedure consists of personalizing (naming) the Entrance Ticket of the Visitor(s) before it is issued. The Organization may require this procedure to be fully completed by a certain date prior to the Event. The Visitor expressly agrees to this.

8.E. The Organization has the right to refuse the acceptance by Visitor to enter into an agreement at any time or to terminate an agreement if, in the opinion of the Organization, there are reasonable grounds to do so . This may be applied, inter alia, if the Visitor has been denied admission to Events due to previous circumstances and/or by attaching additional conditions to admission to the Event.

8.F. The Visitor may never modify or dissolve an agreement concluded with Organization for the purchase of an Entrance Ticket and/or Tokens, unless mandatory statutory provisions would grant him or her that right.

Article 9. Prohibition of resale

9.A. The Visitor is not permitted, without prior written permission from the Organization, to sell (or have sold) Admission Tickets for an Event and to offer (or have offered) them to third parties for commercial purposes. This includes the sale of an Entrance Ticket whereby the seller requests and/or receives a higher amount for the Entrance Ticket than the original amount paid by Visitor for the Entrance Ticket or the price set by the Organization for those tickets. If there has been or threatens to be a violation of the foregoing, the Organization has the right to have the Entrance Ticket declared invalid. There is then no entitlement to a refund for the Visitor. In case of (threatened) violation of this article, the Organization is entitled to deny the Visitor, the buyer as well as the seller of the Entrance Ticket, access to the site and Event and to recover all resulting (consequential) damages, including costs.

Article 10. Coins (Tokens).

10.A. During the Events and on the Terrain, payment by Visitor may be made only with Tokens sold by the Organization, unless otherwise specified by the Organization. Tokens are and shall remain the property of the Organization. Tokens can be purchased both prior to the Event and on the Terrain, unless otherwise indicated by the Organization.

10.B. Each Event and edition has its own Tokens that are only valid during that edition of the Event. Purchased Tokens cannot be returned and are not exchangeable for cash. There will be no refund of Tokens purchased by the Visitor in the event of full or partial cancellation of the Event.

10.C. The Visitor is strictly prohibited from (re)selling Tokens.

Article 11. Accommodation

11.A. For the use of an Accommodation, the agreement between Organization and Visitor comes about as stipulated in Article 8 of these General Conditions. Whereby it is important that the Visitor has also purchased an Entrance Ticket intended for this section and has made payment for a relevant Accommodation.

11.B. It is strictly prohibited for the Visitor to allow third parties to use the Accommodation against payment. The foregoing also applies to whether or not goods or services are offered for sale from this Accommodation.

11.C. The right to use the Accommodation terminates in the following cases without the Organization being obliged to pay any compensation:
1. the agreed period of use has expired;
2. the Visitor is denied access to the Venue and Event or parts thereof;
3. upon full or partial cancellation and/or termination of the Event.

11.D. For the cancellation of an Accommodation by the Visitor, the Visitor must send a written request to Organization for this purpose. Cancellation is possible in a number of situations and, where appropriate, is subject to additional conditions. This provided that the Visitor’s request is received in writing by the Organization and confirmed before the deadlines mentioned:

– cancellation within a period of 3 months or more before the Event is to take place: the Visitor is entitled to a full refund of the costs already charged for the Accommodation (excluding booking fees and possible other costs, such as, for example, administration costs);
– cancellation within a period between 1 month and 3 months before the Event is to take place: the Visitor is entitled to a 50% refund of the cost already charged for the Accommodation (excluding booking fees and possible other costs, such as, for example, administration costs);
– cancellation within a period less than 1 month before the Event is to take place: the Visitor is not entitled to a refund of the costs already charged.

The amount making up the refund will consist only of the costs already charged to Visitor that are directly related to the Accommodation. Other costs including Entrance Tickets will not be refunded.

11.E. The Visitor will behave as a good host/hostess and is responsible for keeping the Accommodation in a tidy condition in which the Organization has made it available. The Visitor is also liable for any damage to, destruction of and/or loss of (parts of) the Accommodation. It is strictly forbidden to smoke, use open fire and/or light fireworks in the Accommodation. It is not allowed to admit more persons to the Accommodation than the maximum number allowed by the Organization. The Organization will determine the location of the Accommodation on the Terrain.

11.F. The Visitor shall use and treat the Accommodation in accordance with the purpose for which it was rented, and shall behave as a good and diligent host/hostess therefor. The Visitor has the obligation to notify the Organization immediately if any defect or loss to the Accommodation has occurred or was already present when the Visitor first entered the Accommodation. The Organization is not liable for loss or theft of the Accommodation and also damage to it. This also applies to items and information that Visitor has left behind in it. The above also applies if third parties would be liable for loss, theft or damage. The organization strongly advises Visitor not to leave valuables in an unattended Accommodation.

11.G. Visitors who have reserved an Accommodation (including any co-users) must also have a valid Entrance Ticket for the Event in order to use the Accommodation. Upon arrival at the Event Site and upon submission of the Entrance Ticket for the Accommodation and presentation of a valid ID, the Visitor will be granted access to the Accommodation designated by the Organization.

Article 12. Campsite

12.A. For the use of a place at the Campground, the agreement between Organization and Visitor comes about as stipulated in Article 8 of these General Conditions. Whereby it is important that the Visitor has also purchased an Entrance Ticket intended for this section. Access to the campsite is always limited to one Visitor who has purchased an Entrance Ticket for this specific part of the site.

12.B. It is strictly prohibited for the Visitor to allow third parties to use the Camping for payment. The foregoing also applies to offering goods or services for sale or otherwise from the Camping.

12C. Access to the Campsite and to and from other parts of the Terrain to the Campsite will always be subject to an access control similar to that described with respect to access to the Event described in these General Conditions.

12D. Specific House Rules for the Campground have been established to supplement these General Conditions. The Visitor is obliged to comply with them. Visitors who visit the Camping are allowed to bring more items than those described in these General Terms and Conditions, insofar as these House Rules are regulated. The items mentioned in the House Rules are only allowed on the Camping and not on other parts of the Terrain. These House Rules can be consulted on the website of the relevant Event and are also available for inspection at the office of the Organization and at the entrance to the Event. The Visitor expressly agrees to the House Rules and will also behave in accordance with these House Rules.

12E. The right to use a site at the Campground ends in the following cases without the Organization being liable for any compensation:
1. the agreed period of use has expired;
2. the Visitor has been denied access to the Venue and Event or parts thereof;
3. upon termination of the Event;
4. upon early departure on Visitor’s own initiative.

12F. The Visitor will be assigned a portion of the Terrain upon entering the Campground where he can pitch his tent. Normally, this allocation will take place in order of entry unless the Organization has decided otherwise. If the Visitor wishes to pitch his tent next to other Visitors, he will have to enter at the same time as the other Visitor(s). After the allocation of a place on the Campground it is not possible to use another place. It is strictly forbidden to stay in a tent with more people than specified by the tent manufacturer. Normally this means that no more than 8 people should stay in one tent.

12.G. The Organization is never liable and excludes liability for destruction, loss, theft, destruction and / or damage to property and information of Visitor. The urgent advice from the Organization to Visitor is not to leave valuables unattended at the campsite.

Article 13. Media (equipment).

13.A. During the Event, photographs, audio and film recordings will be made on behalf of or with the permission of the Organization. The Visitor explicitly and irrevocably agrees that on and around the Venue and during and around the Event, visual and/or audio recordings will be made of Visitors to the Event and that these will be distributed by or on behalf of Organization through all possible forms of media, now and in the future known. In this context, the Visitor grants the Organization and its licensee(s) the irrevocable and perpetual right to use his or her portrait, image and persona anywhere in the world through all possible forms of media, now and in the future, including but not limited to the promotion and exploitation of the Event and the Organization (including aftermovies, teasers, social media) and for use for the archive and portfolio of the Organization.

13.B. Without the express prior written consent of the Organization, distribution, emphasis, editing or copying of the following is prohibited:
1. posters, flyers, other printed materials and digital expressions of the Organization;
2. the program booklet.

13.C. The Visitor is permitted to bring photographic equipment (non-professional) onto the Premises during the Event and use it. Non-professional photographic equipment means:

1. phones with photo camera;
2. disposable devices;
3. digital compact cameras with normal and fixed lens.

Professional photographic and film equipment and/or other (audio) recording equipment are strictly prohibited. If in doubt as to whether your equipment is permitted, please contact the Organization by e-mail for evaluation prior to the Event. Not permitted are at least the following equipment:

1. GoPro;
2. Telescoping Pole;
3. Movie camera.

13.D. If the Visitor does not comply with the said conditions on the Terrain, the Organization may take the following measures. Also, in case of violation, the Organization has the right to proceed with the removal of the Visitor from the Terrain without the Organization refunding the entry fee.

The Organization shall also have the right to take temporary custody of the equipment, at the discretion of the Organization: – the Event has ended – a time to be determined if the Organization has reasonable grounds to do so – it has been demonstrated by the Visitor that all recordings and possible reproductions thereof have been erased.

13.E. Photographers, whether professional or not who wish to take photographs or film footage of the Event for commercial purposes, must be in possession of a valid accreditation issued by the Organization when entering the Venue and during the Event.

13.F. The Organization is authorized to carry out checks on Visitor to see if there has been any violation of the aforementioned articles and also to confiscate or destroy registrations. At the first request of or on behalf of the Organization, Visitor shall cooperate with such inspection.

Article 14. Event Registration.

14.A. By attending the Event, the Visitor expressly agrees that it is permitted for the Organization to record or have third parties record image and sound recordings of the Event and the Visitor. This authorizes the Organization to exploit, disclose, reproduce and distribute these recordings (or have them exploited) in any form and manner whatsoever, in the broadest sense of the word. By concluding the agreement and entering the Event, the Visitor grants unconditional and irrevocable permission to make, edit, use and exploit these recordings and the portrait, image and persona of the Visitor recorded therein. The Organization shall never owe the Visitor any compensation for this.

14.B. If the Visitor is entitled to any rights including copyright and neighboring rights relating to the aforementioned recordings, the Visitor hereby assigns such rights to the Organization without restriction. If and to the extent necessary, Visitor shall at the first request of Organization cooperate with all formalities to effect this transfer of rights. The Visitor hereby irrevocably waives, to the extent permitted by law, his or her personality rights, on the understanding that the Visitor shall have no recourse thereto against the Organization and its licensee(s), if any. If the aforementioned transfer is not legally valid in advance, then the Visitor is obliged, at the first request of the Organization, to give the necessary written consent or to sign a deed of transfer in which the aforementioned rights are still transferred to the Organization.

Article 15. Personal data and privacy

15.A. The Organization processes personal data of Visitors and of Visitors to its websites in accordance with the General Data Protection Regulation (AVG) and in accordance with the Organization’s AVG-compliant privacy policy, the most current version of which can be viewed through the Organization’s websites.

Article 16. Other provisions

16.A. The Organization has at all times the right to immediately remove or have removed from the Site and the Event any Visitor who violates or threatens to violate one or more provisions of this article. The Organization is not obliged to refund the entrance fee, purchased Tokens and is also authorized to refuse the Visitor access to future Events. The Visitor is also obliged to reimburse the Organization for any fines imposed on the Organization, damages suffered and costs incurred in connection with his actions.

16.B. It is strictly prohibited for a Visitor who has not reached the age of 18 years to purchase, carry, drink or attempt to obtain alcoholic beverages. Regardless of his or her age, the Visitor is strictly prohibited from providing alcoholic beverages (whether for payment or not) to anyone who has not yet reached the age of 18.

16.C. Toilet facilities are available on the Terrain. These are generally accessible free of charge unless otherwise indicated. The Visitor is obliged to use these facilities. It is strictly prohibited to defecate or urinate in places other than the toilet facilities designated for this purpose.

16.D. The Visitor is strictly prohibited from throwing liquor, fireworks or other objects and/or from behaving in such a way as to disturb or threaten to disturb order at the Event.

16.E. Smoking is strictly prohibited in all indoor venues and indoor locations on the Premises.

16.F. It is strictly prohibited to steal and destroy property of the Organization, other Visitors and third parties on and/or around the Terrain. The theft and destruction of property of the Organization, other Visitors and third parties is considered a criminal offense. This will be immediately reported by the Organization to the police.

16.G. It is strictly prohibited for the Visitor to offer, sell goods, substances and/or resources on or around the Terrain before, during and after an Event without the explicit written consent of the Organization. It is also prohibited to advertise on or near the Terrain in the broadest sense of the word before, during or after an Event. In the event of violation of this Article 16G, the Visitor forfeits an immediately payable fine of at least €750 for each violation, without prejudice to all other rights of the Organization, including the right to claim compensation for the damage actually suffered.

Article 17. Final Provisions

17.A. These general conditions are exclusively governed by Dutch law. The general terms and conditions have been drawn up in Dutch and translated into English. In the event of any inconsistency between the Dutch version and the English translation, the Dutch version shall be binding. The District Court in ‘s-Hertogenbosch is exclusively competent to take cognizance of disputes that are directly or indirectly related to any agreement or legal act to which these general terms and conditions apply.

17.B. To the extent that the court designated in these terms and conditions, in the case of an agreement with a Visitor who is a consumer, does not have relative jurisdiction, the Visitor shall be entitled, within one month after the Organization has invoked this article in writing, to opt for settlement of the dispute by the court with relative jurisdiction under the law.

17.C. In the event of a disturbance / misbehavior, the Visitor’s personal information will be immediately transmitted to the police.
